SNP Waivers
Summer Mandate Waiver  Minimize 
Texas law mandates that public school districts in which 50% or more of the enrolled students are eligible to receive NSLP free or reduced-price meal benefits must operate SFSP/SSO, partner with another organization, or request and receive a waiver approval from TDA.

Application Period: November 31st—January 31st

*In addition to the waiver request, a written notice of intent to request a waiver must be sent to the local school health advisory council (SHAC) no later than November 30.

Seamless Summer Option Age/Grade Group Meal Pattern Portion Size  Minimize 

Contracting Entities participating in the Seamless Summer Option may apply for a waiver to serve the same portion size to all students based on the most common age/grade group at the summer meal site. Open and Restricted-Open sites are eligible.

Universal Breakfast Waiver  Minimize 
Free breakfast must be offered to all students if 80% or more of the enrolled students qualify for free or reduced-priced meals. Campuses wishing to opt out of offering breakfast at no cost must first receive approval by the board or governing body before requesting a waiver.

Hiring Professional Standards Exemption (<2499)  Minimize 
Contracting Entities with a total student enrollment of 2499 or less may apply for an exemption to the professional experience requirements for hiring professional standards for a program director.

Gender Separation Exception  Minimize

Technology Based Confirmation  Minimize 
Contracting Entities using a technology-based system that demonstrates a high-degree of accuracy (less than 5% error rate) may request approval from TDA to have the confirmation review requirement waived.

Vending Machines to Dispense Reimbursable Meals  Minimize 
Contracting Entities may request to use vending machines as a method of serving a reimbursable meal as long as the vending machines are able to price a reimbursable meal as a unit, and the request is approved by TDA.

Non Congregate Feeding for Extreme Heat  Minimize 
Summer Food Service Program (SFSP) and Seamless Summer Option (SSO) Contracting Entities (CE) may register their intent to participate in the USDA demonstration project in TX-UNPS CE and Site Application. This data submission form must be used to report the non-congregate meals served when the National Weather Service issues a Heat Advisory, Excessive Heat Warning, or Excessive Heat Watch.

Child Nutrition Program Waiver  Minimize 
This waiver is intended to use if an applicable form is not found in the options above. These requests require final approval by USDA.
