National Disqualified List/Texas Excluded SFSP List
Organizations, responsible principal(s), and responsible individual(s) that are disqualified from participation in the CACFP are placed on the USDA-maintained National Disqualified List (NDL), and those disqualified from participation in the Summer Food Service Program are placed on the Texas Excluded SFSP List (TEXSL). Parties and organizations on either list will remain on those lists for a minimum of seven years from the date of disqualification unless a debt is owed under those respective programs, in which case they will remain on the applicable list until the debt has been repaid. Any applying or current CACFP or SFSP Contracting Entity should check the NDL and TEXSL to ensure that no individuals on those lists are hired to perform Program functions with their own organization, or at a sponsored site or day care home provider.

Accessing the NDL and TEXSL Online

Contracting entities (CEs) will now access the lists of institutions and individuals disqualified from CACFP directly from the U.S. Department of Agriculture’s (USDA) National Disqualified List application. These web-based lists provide information the moment it is entered by the state agencies, thereby ensuring CEs have accurate up-to-date information when hiring new staff or adding sites and/or providers.

The first step is for CEs to request access to the website. “How to Request Access to the NDL” provides the instructions to request and receive that access, as well as how to search the information once access is granted.

Once a CE has received access, the website can be accessed 24 hours a day here.

 

To access the TEXSL list containing institutions and individuals disqualified from SFSP, go to TX-UNPS, access either the CACFP or SFSP modules. Select the Menu item “Applications” and then “Download Forms”. The TEXSL list is Form SFSP-105.

Requesting Early Removal from the NDL or TEXSL

For disqualifications because of serious deficiencies that do not indicate a lack of business integrity, organizations and individuals may submit a request to be removed from the either the NDL or TEXSL before the seven years have elapsed via the Removal Request Form - National Disqualified List or Texas Excluded Summer Food Service Program List.


Please note the following:
  • Submission of a request does not guarantee the request will be approved;
  • Denial of a request for early removal is not subject to appeal; and
  • Approval of a request for early removal does not equal approval to participate in the CACFP, SFSP, or any other Child Nutrition Program. A new application for participation in the applicable program must be submitted and processed in accordance with TDA’s application process.

Due to the egregious nature of certain activities, TDA will not consider a request for early removal of an organization or individual who was disqualified for falsification of records, making false representations, making false claims, engaging in an unlawful practice, or any other activity indicating a lack of business integrity.

Serious Deficiency Notification Process for CACFP Sponsors

Sponsors of day care home providers, unaffiliated child care centers, At-Risk centers, or Adult Day Care centers must initiate the Serious Deficiency process if they discover that one of their sponsored sites/providers consistently violates Program requirements and/or the violations are severe enough to demonstrate systemic management problems preventing successful operation of the Program.

For each step of the process, sponsors must submit a written notice to the seriously deficient site and submit a copy of that notice to TDA at the same time. Sponsors may not wait until the process is completed to send copies of all letters to TDA. All notices must be submitted via the CACFP Serious Deficiency Process Notification Form.

Sponsors are encouraged to use the SD Notification Template Letters available on the CACFP Administration/Forms page. If using your own format, all elements from TDA’s templates must be included.

Failure to submit an updated form to TDA during each step of the process could result in the Sponsor being placed in the Serious Deficiency Process.

NOTE: If the site/provider fails to correct the serious deficiency(ies) by the end of the process, the sponsor will submit a Notice of Termination and Disqualification to the site and submit a copy of the notice to TDA via the SD Process Notification Form. At the same time, the sponsor must also upload copies of official identification documentation for any responsible principals/individuals who are being disqualified to allow for TDA’s processing of those individuals for the National Disqualified List.

To file a program discrimination complaint, a Complainant should complete a Form AD-3027, USDA Program Discrimination Complaint Form which can be obtained online at: https://www.usda.gov/sites/default/files/documents/ad-3027.pdf, from any USDA office, by calling (866) 632-9992, or by writing a letter addressed to USDA. The letter must contain the complainant’s name, address, telephone number, and a written description of the alleged discriminatory action in sufficient detail to inform the Assistant Secretary for Civil Rights (ASCR) about the nature and date of an alleged civil rights violation. The completed AD-3027 form or letter must be submitted to USDA by:
