" TDA has just released the Unanticipated CACFP Facility Closure Notification and Waiver Request Form. Through June 30, 2027, independent CACFP centers facing an unanticipated closure, or sponsors of CACFP sites or providers that are forced to close temporarily due to an unanticipated weather or other emergency event, must notify TDA of the closure if these facilities intend to continue to serve meals, either from an alternate site or via non-congregate service at the closed site.

TDA has released a new Unanticipated Facility Closure Notification/Waiver request form specifically for non-SFA CACFP operators.* Through June 30, 2027, TDA has been given the discretion by USDA to grant non-congregate waivers to any type of CACFP facility in good standing that is forced to close unexpectedly due to an unanticipated weather event or other unexpected emergency. Independent centers facing a closure, or sponsors of sites or providers facing a closure, must submit this form on behalf of the site and receive approval before claiming any non-congregate meals served during the closure.
During a validated, unanticipated closure, available non-congregate flexibilities allow for parent pick-up, multi-day meal bundling, and meal service time deviations. However, granted waivers may only be used for up to 10 calendar days per approval. TDA monitors each closure carefully and will request an extension from USDA if the closure exceeds 10 days.
The following restrictions apply:
- If issuing meals for multiple days, meals should be claimed based on the days of intended consumption and only on days approved for service in the TX-UNPS site application.
- At-risk enrichment requirements may be waived during the closure, but all area eligibility requirements remain in effect for any locations where At-risk meals are distributed.
- The facility must return to serving congregate meals once the facility reopens.

*NOTE: School Food Authorities that experience a school closure but are choosing to use CACFP At-risk meals to serve children during the closure must submit the Unanticipated School Closure form on the NSLP Administration/Forms page.

The letter must contain the complainant’s name, address, telephone number, and a written description of the alleged discriminatory action in sufficient detail to inform the Assistant Secretary for Civil Rights (ASCR) about the nature and date of an alleged civil rights violation.
