Updated Nondiscrimination Statement

" June 1, 2022 - The Nondiscrimination Statement required on all public-facing Program materials has recently been updated to account for a recent court decision determining that the prohibition of discrimination based on sex in Title IX and the Food and Nutrition Act includes gender identity and sexual orientation.
June 1, 2022 - On May 5, 2022, the Food and Nutrition Service’s (FNS), Civil Rights Division, issued a memorandum on Bostock v. Clayton County and its application to USDA FNS Programs. The memorandum informed FNS program recipients that the prohibition of discrimination based on sex in Title IX and the Food and Nutrition Act includes gender identity and sexual orientation. The changes impact the USDA Nondiscrimination Statement (NDS).

The revised USDA NDS includes updated language for all other FNS programs. TDA is in the process of updating its handbooks, forms, and resources to reflect the new NDS, which can be found here: https://www.fns.usda.gov/civil-rights/usda-nondiscrimination-statement-other-fns-programs

NOTE: Currently a Spanish translation is being developed by USDA.

Operators using their own materials that include the NDS must update those materials when current supply on hand is exhausted or by September 30, 2023. All new printing should use the updated NDS.

To file a program discrimination complaint, a Complainant should complete a Form AD-3027, USDA Program Discrimination Complaint Form which can be obtained online at: https://www.usda.gov/sites/default/files/documents/USDA-OASCR%20P-Complaint-Form-0508-0002-508-11-28-17Fax2Mail.pdf, from any USDA office, by calling (866) 632-9992, or by writing a letter addressed to USDA. The letter must contain the complainant’s name, address, telephone number, and a written description of the alleged discriminatory action in sufficient detail to inform the Assistant Secretary for Civil Rights (ASCR) about the nature and date of an alleged civil rights violation. The completed AD-3027 form or letter must be submitted to USDA by:
