Reminder: Acceptance of USDA Foods Delivered by State-Contracted Warehouses

" TDA would like to issue the following friendly reminder regarding the do's and don'ts to accepting USDA Foods at time of delivery by a state-contracted warehouse.

In an effort to minimize the volume of rejected/returned product, this is a reminder that all items of USDA Foods delivered by the state-contracted warehouse must be accepted in whole by the school Contracting Entity (CE) at time of exchange. This is especially the case if the warehouse is delivering everything on a CE Delivery Order placed by the CE. Per the current Request for Proposal, state-contracted warehouses may also add short-shelf and/or time-sensitive items to a CE’s Delivery Order (fresh produce and dairy products) but must provide notification of doing so prior to the delivery date. CEs should also accept USDA Foods items added by the state-contracted warehouse provided the CE was given an opportunity to modify the additions to the order prior to the delivery date.

The exceptions to this policy include the approval to reject the portion of USDA Foods identified as out-of-condition or portions of a delivery order added by a state-contracted warehouse to which the CE was not given advance notification (except for sensitive shelf-life items). CEs may only reject the affected portions of the order under these conditions.

The letter must contain the complainant’s name, address, telephone number, and a written description of the alleged discriminatory action in sufficient detail to inform the Assistant Secretary for Civil Rights (ASCR) about the nature and date of an alleged civil rights violation. The completed AD-3027 form or letter must be submitted to USDA by:
