Upcoming Texas Administrative Code rule review

" January 1, 2022 - This is a preliminary notice that TDA will be conducting an official routine review of the Texas Administrative Code, Title 4 Appeal Procedures, CACFP and SFSP rules. Notice of these rule reviews will be posted in the Texas Register, and TDA will be requesting comments from the public.

January 1, 2022 -  The Texas Department of Agriculture is conducting an official routine review of the following rules:
• Texas Administrative Code, Title 4, Part 1, Chapter 1, Subchapter P, Appeal Procedures for the Food and Nutrition Programs
• Texas Administrative Code, Title 4, Part 1, Chapter 25, Subchapter A, Child and Adult Care Food Program (CACFP).
• Texas Administrative Code, Title 4, Part 1, Chapter 25, Subchapter B, Summer Food Service Program (SFSP).

This review is being conducted in accordance with the requirements of Texas Government Code §2001.039 (Agency Review of Existing Rules).TDA will consider whether the initial factual, legal, and policy reasons for adopting each rule continue to exist and whether these rules should be repealed, readopted, or readopted with amendments.

As part of this review, we intend to publish a notice of proposed rule review for these chapters in the Texas Register requesting comment from the public. The deadline for comments is 30 days after the rule review notice is published in the Texas Register.
Following this rule review, we intend to publish in the Texas Register any proposed amendments should they be considered appropriate.
